These Terms of Service ("Terms") are a legal agreement between you and Castmates ("Castmates", "we", "us", or "our") and govern your use of the Castmates iOS application (the "App"), the website get-castmates.com, and related services. This agreement also serves as the end-user license agreement (EULA) for the App. By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 17 years old (or the age of majority in your jurisdiction, if higher) to use the App, and at least 18 years old to enable optional Mature (18+) content. By using the App you represent that you meet these requirements and that you are not barred from using it under any applicable law.
2. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, sublicense, or distribute the App except as expressly allowed by law.
3. The App is for entertainment — AI-generated content
Castmates lets you chat and roleplay with fictional AI characters. All characters and their responses are fictional and generated by an AI model for entertainment purposes only. Outputs are produced automatically and may be inaccurate, misleading, offensive, inappropriate, or otherwise objectionable. They do not represent our views, and we do not endorse, verify, or take responsibility for AI-generated content.
Not professional advice. Characters may portray roles such as a coach, mentor, doctor, therapist, or other figure. They are fictional and are not a substitute for professional advice of any kind, including medical, mental-health, legal, financial, or safety advice. Do not rely on the App for such matters. If you are in crisis or may be a danger to yourself or others, contact your local emergency services or a qualified professional immediately.
4. Your responsibilities and acceptable use
You are solely responsible for how you use the App, for everything you type into it, for the custom characters and scenarios you create, and for how you use or act on any output. You agree that you will not use the App, and will not use any content generated by it, to:
- violate any law, regulation, or third-party right;
- create, request, or attempt to generate any content that sexually exploits or endangers minors, or that depicts minors in a sexual manner;
- harass, threaten, defame, stalk, or harm any person, or incite or facilitate violence or illegal acts;
- generate content intended to deceive or impersonate a real person, or to produce non-consensual, intimate, or defamatory depictions of real individuals;
- attempt to circumvent safety features, age gates, or technical limitations of the App.
Optional Mature (18+) content is provided for consensual, fictional, adult roleplay only and is your choice to enable. You remain responsible for ensuring your use is lawful where you live.
5. Content you create
Custom characters, prompts, and conversations are created and stored on your device. As between you and us, you are responsible for them, and you represent that your inputs do not infringe anyone's rights or violate these Terms. Because this content stays on your device, we do not claim ownership of it and generally do not have access to it.
6. Subscriptions, billing, and cancellation
Castmates offers a free tier with usage limits and an optional paid subscription ("Pro") that unlocks additional features. Subscriptions are sold and billed by Apple through your App Store account. There is no free trial; the free tier lets you try the App before subscribing. Subscriptions automatically renew at the then-current price until canceled, and your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings. Payments are generally non-refundable except as required by law or by Apple's policies. Prices may change; we will provide notice as required.
7. Intellectual property
The App, the Castmates name and logo, the preset characters, the character artwork, and all related software and content are owned by us or our licensors and are protected by intellectual-property laws. Except for the license granted above, no rights are granted to you.
8. Disclaimer of warranties
The App and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any AI output will be accurate, appropriate, or suitable for your purposes. You use the App at your own risk, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the App or any AI-generated content, even if we have been advised of the possibility of such damages. To the extent a court nonetheless finds us liable, our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid us for the App in the twelve (12) months before the claim, or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Castmates and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your inputs or custom content, your use of any AI-generated output, or your violation of these Terms or any law or third-party right.
11. Apple — Licensed Application terms
These Terms are between you and us only, not with Apple, and Apple is not responsible for the App or its content. You and we acknowledge that:
- Apple has no obligation to furnish any maintenance or support for the App;
- in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs, or expenses are our responsibility, not Apple's;
- we, not Apple, are responsible for addressing any claims by you or any third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws;
- in the event of any third-party claim that the App or your use of it infringes intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim;
- you represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Suspension and termination
These Terms apply until terminated. Your license ends automatically if you fail to comply with them. You may end the agreement at any time by deleting the App. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and intellectual-property terms) survive termination.
13. Governing law
These Terms are governed by the laws of Croatia, without regard to its conflict-of-laws rules, except where the mandatory consumer-protection laws of your country of residence provide otherwise.
14. Dispute resolution
If a dispute arises out of or relating to these Terms or the App, you agree to first contact us at support@get-castmates.com so we can try to resolve it informally. Any dispute that cannot be resolved informally will be settled by binding arbitration conducted in accordance with the laws of Croatia. Nothing in this section prevents you, where you are a consumer, from bringing proceedings in the courts of your country of residence where applicable law gives you that right.
15. Changes to the App
We may modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice, to the extent permitted by law.
16. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the App after changes take effect means you accept the updated Terms.
17. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire agreement
These Terms, together with our Privacy Policy and the App Store Terms of Service, make up the entire agreement between you and us regarding the App and supersede any prior agreements on that subject.
